Terms of Engagement

Acceptance of Services: Once a package or individual service has been selected the client will supply the following information:

  1. Full Name.
  2. Nationality
  3. NEI / DNI / Passport details
  4. Client's residential address if different to the property to be serviced / managed.
  5. Email address
  6. Contact telephone number (In case of any emergencies only)
  7. 2 sets of keys to the property. If only 1 set is provided PMS will undertake to make a duplicate set and charge the client accordingly.
  8. Alarm code for access to provide the services requested.
  9. Copy of Building and Contents Insurance Policy

Client's Management Account: PMS will provide an account for the sole purpose of managing / servicing the client's property. We will supply monthly statements with supporting invoices.

Payment of PMS invoices: The client agrees to pay PMS's charges / costs on receipt of the invoice via email. Should there be any delays in payment PMS reserve the right to charge an additional 10% surcharge to any outstanding invoices.

Additional Services: PMS will undertake to carry out any additional services as and when the client requests them subject to written agreement. The agreed costs will then be invoiced via email and the client agrees to pay on receipt.

Payments made on behalf of the Owner: If PMS is requested to pay any bills on behalf of the owner, these will be subject to a 10% administration fee plus IVA at the current rate.

IVA: All published and agreed costs are subject to IVA at the current rate.

Service Charges / Insurances relating to the property: The client is wholly responsible to pay Service Charges such as Water, Electricity, Property Tax etc. Also any insurance relating to the building and contents of the property. PMS are not liable for any loss, damage or breakages on the property, internal or external.

Termination of Agreement: By either party will be made in writing by email or post giving 90 days notice. Outstanding charges / fees will be forwarded to the client with a 15 % administration fee on the final balance.

Breach of Agreement: PMS may terminate the agreement forthwith if the client breaches any of the points of the agreement. In the case of outstanding fees PMS will undertake to recover these through the Spanish legal system.

Arbitration: Any disputes that arise will be subject to the Laws of Spain.
